Are Smoking Bans Constitutional?

At 12:01AM on February 1st, a statewide smoking ban went into effect in Maryland, making it illegal to smoke at indoor bars or restaurants as long as employees are present. Owners who allow smoking after that Thursday night face fines. My husband and I have had some spirited discussions on the subject, because while neither of us smoke, I'm in favor of the ban and he thinks the state is overstepping its bounds. I sort of agree with him, but I'm still in favor of the ban for mostly selfish reasons. ...more
