Wells Fargo Beyond Today Official Rules

THIS IS A JUDGED CONTEST. NO ENTRY FEE OR PURCHASE IS REQUIRED TO PARTICIPATE. The Wells Fargo Blog Contest (“Contest”) runs on www.blogher.com from 9:00 a.m. Pacific Time (“PT”) on 7/16/12 and ends at 5:00 p.m. PT on 8/15/12 (Contest Period). To enter, you must submit a 250 word or less essay (“Blog”) on one of two Contest topics: “Your personal relationship with money”, or “Your thoughts on a topic blogged about on Wells Fargo’s Beyond Today® website” located at http://blog.wellsfargo.com/retirement/. The Contest winner will receive $2,500 and five runners up will each receive $500. All six Blogs will be displayed on Wells Fargo’s Blog for women – “Beyond Today” in the first quarter of 2013.

ELIGIBILITY

Open to legal residents of the United States, 18 years of age and older at the time of entry. Employees, officers and directors of Wells Fargo Bank, N.A., Wells Fargo Advisors, LLC (collectively, “Sponsor” or “Wells Fargo”), BlogHer, Inc. and their respective partners, subsidiaries, and affiliated companies, successors and assigns, their advertising, promotional or fulfillment agencies, businesses that advertise their goods/services on www.blogher.com (individually and collectively, “Entities”), and their immediate family members [spouses, parents, children, siblings] and individuals residing in their same household (whether or not related) are not eligible. Void where prohibited or restricted by law.

You will be asked to provide your first and last name, email address and write in 250 words or less copy for a potential Blog on either of the two topics (the “Submitted Blog”):

What kind of relationship do you have with your money? Is it love, hate, nurturing, negligent or just tolerant, or something else? Provide an open and honest perspective on your relationship with money.

  1. Or, give your opinion about a post you’ve read on the Beyond Today blog that has resonated with you. Do you agree, disagree, have an insight on the topic or more information.

 

Only one entry per person per email address is allowed. Only entries submitted through the BlogHer website will be accepted.  If more than one entry is received by an entrant,  all subsequent entries will be disqualified. Entries may not be submitted to a Wells Fargo Branch. Entries that are lost, late, incomplete, illegible, misdirected, corrupted and exceed the stated word limits are void and will not be accepted. Submitted Blogs become the property of Sponsor and will not be returned.

Submitted Blogs must be entrant’s original creation and must not include third party copyrighted or trademarked material. Submitted Blogs requiring license or usage rights from any third party are not eligible. Submitted Blogs cannot defame or invade the rights or privacy of any person, living or deceased, or otherwise infringe upon any third party’s personal, proprietary or intellectual rights. Submitted Blogs must be consistent with the Sponsor’s reputation in the marketplace, be suitable for audiences of all ages and may not contain any type of vulgarity, objectionable content or language that defames, misrepresents or contains disparaging remarks about people or companies or they will be disqualified. Entries that do not meet these stated criteria or entries that (in the judges’ sole discretion) may technically meet the stated criteria but do not reflect the intent and the spirit of this Contest or the provisions of these rules are not eligible.

As a condition of entry, entrant must certify that the information provided in the Entry Form is true and accurate, that the Submitted Blog is of their own creation and does not violate third party rights and entrant agrees to assign all rights and interest in the Submitted Blog to the Sponsor. Sponsor reserves the right to conduct a background check on any potential Winner and reserves the right in its sole discretion to disqualify any entrant based on such background check if in its sole discretion, the Sponsor determines that awarding a prize to such an entrant might reflect negatively on the Entities, image and/or reputation.

EVALUATION AND JUDGING

 A Judging Board (Judges) comprised of approximately four judges will evaluate all eligible Blogs received during the Contest Period to select one winner and 5 runners up. On a range from 1 to 10 (10 being the highest score), Judges will evaluate eligible submitted Blogs based on the following judging criteria. This criteria applies to either topic selected.

  1. Substantive- clear, logical and well-focused content – 25%
  2. Emotional connection - the writer’s feel for the topic is conveyed – 25%
  1. Creative – unique, original thinking and approach to the selected topic – 25%
  2. On topic – Content supported by experience, ideas, research, observations, etc.– 20%
  3. Craftsmanship – proper sentence structure, grammar, spelling – 5%
     

Any ties will be determined by the Judges upon the highest score reached by the tied entrants for the Substantive criteria, followed by the Emotional Connection criteria and the Creative criteria in such order as needed. 

PRIZES: A total of six (6) cash prizes will be awarded. The entrant with the highest score (Grand Prize winner) as determined by the judges will receive $2,500 and the five next highest scoring entrants will each receive $500 (“Runners up”).   

PRIZE AWARD: The six potential winners will be determined on or about 9/5/12 and notified by email by a Wells Fargo representative on or about 9/7/12 to the email address used to enter the Contest. If a potential winner does not reply to the email within 5 business days of the date on the email or s/he is determined to be ineligible, s/he will be disqualified and the next alternate winner will be selected in order from the Runners up list as prepared by the Judges during the selection process. After each winner responds via email, the winners will be sent the Contest Paperwork by overnight mail. If the Paperwork is not returned within ten (10) business days of the date on the Contest Paperwork, winner will forfeit the prize and an alternate winner will be selected.  The Grand Prize winner will be required to complete an Affidavit of Eligibility, Liability and Publicity (where permitted by law) Release. Runners up will be required to complete a Declaration of Eligibility, Liability and Publicity (where permitted by law) Release. A potential Grand Prize winner who is not the age of majority in the State in which s/he resides will be required to have his or her parent or legal guardian complete the Affidavit in order to be eligible to receive the prize. If the Affidavit/Declaration - properly executed - is not returned within 10 business days of the date on the notification, the potential winner is found to be ineligible, or the potential winner does not comply with these Official Rules, the prize will be forfeited and the next highest scoring entrant will be awarded the prize.  Prize winners will receive their prize at the address provided on their Affidavit or Declaration within 14 business days of verification. Except as otherwise indicated, no substitution or transfer of prize will be allowed; however, Any expenses relating to the acceptance and use of a prize not specified are the sole responsibility of the Winners. A potential Winner who is disqualified for any reason will not be entitled to any form of compensation.  Any and all applicable federal, state, and local taxes or other assessments on a prize are the sole responsibility of the Winners. Grand Prize Winner will receive a 1099 Tax Form reflecting the prize value.

RELEASE

Entrants agree (for entrant and for entrant’s heirs, executors and administrator) to release and hold harmless Sponsor, BlogHer, Inc., and their affiliates, partners, promotion and advertising agencies, Judges and any other entities or Sponsor’s agents (collectively, the “Contest Entities”)  involved in administering this Contest and fulfilling the prizes.  By entering, all entrants hereby release the Contest Entities from and against all claims and damages arising in connection with each entrant's participation and/or entry in the Contest and/or his/her receipt or use of the Prize(s) awarded in this Contest. Each winner consents to the use by the Contest Entities and their designees the Submitted Blog and name submitted for entry during the Contest Period, for advertising and promotional purposes in any and all media, now or hereafter known, worldwide without limitation and without additional compensation, notification or permission, except where prohibited by law. The Contest Entities and their designees may exploit, edit, modify, and distribute any Submitted Blog without limitation, (including the names and likenesses of any persons or locations embodied therein) in any and all media, now known or not currently known, throughout the world in perpetuity without additional compensation, permission or notification to any winner.  Additionally, Entrants release the Contest Entities and their  respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors from any and all liability for loss, harm, damage, illness, injury, cost or expense whatsoever including - without limitation - property damage, personal injury and/or death claims and damages which may occur directly or indirectly, whether caused by negligence (except for gross negligence) or not, in connection with, preparation for, or participation in the Contest (including submission of Entry), or possession, acceptance and/or use or misuse of the Prize or participation in any Contest-related activity/event. Furthermore, Entrants shall waive and hold all the above persons and Contest Entities harmless from any claims arising from the Entry submission by an entrant or uses by Contest Entities and their agents of the Entry based on actual or alleged exploitation or use of any Entry, and/or publicity rights, defamation, invasion of privacy, breach of contract, copyright infringement, trademark infringement or any other intellectual property-related cause of action (including irreparable harm and moral rights claims).  Liability for any applicable taxes including, without limitation, all income and sales taxes, surcharges or other expenses not specifically provided for by the Contest Entities in these Official Rules, will be the sole responsibility of Winners. Any required tax reporting will be furnished to the Internal Revenue Service by Sponsor.

GENERAL: Entrants further agree to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Contest itself (to the extent permitted by law), and to be bound by all decisions of the Contest Entities and Judges respectively, which are binding and final.

SPONSOR, BLOGHER, INC. AND ENTRANTS AGREE THAT ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF YOU, AND THE CONTEST SPONSOR/CONTEST ENTITIES IN CONNECTION WITH THE CONTEST (IF ANY), SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH, THE SUBSTANTIVE LAWS OF THE STATE OF CALIFORNIA, WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES (WHETHER OF THE STATE OF CALIFORNIA OR ANY OTHER JURISDICTION), WHICH WOULD CAUSE THE APPLICATION OF THE LAWS OF ANY JURISDICTION OTHER THAN THE STATE OF CALIFORNIA. ENTRANTS AND CONTEST ENTITIES IRREVOCABLY SUBMIT AND CONSENT TO THE EXCLUSIVE JURISDICTION AND VENUE OF THE STATE AND FEDERAL COURTS LOCATED IN OR CLOSEST TO THE COUNTY OF LOS ANGELES IN THE STATE OF CALIFORNIA AND AGREE NOT TO RAISE THE DEFENSE OF FORUM NON CONVENIENS.

Contest Entities, in their sole discretion, reserve the right to change these Official Rules at any time and to suspend, modify or cancel the Contest or any entrant’s participation in the Contest should viruses, bugs, unauthorized human intervention or other causes beyond the Contest Entities’ control (including, without limitation, any unanticipated occurrence that is not fully addressed in these Official Rules that) affect the administration, security or proper play of the Contest or Contest Entities otherwise become (as determined in their sole discretion) incapable of running the Contest as planned. Notice of such cancellation, modification, or suspension will be provided in writing to the participants. In the event that the Contest is cancelled, Sponsor will judge the Blogs submitted to the point of termination and award the prizes at its sole discretion. Entrants who violate these Contest Rules, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to the Contest Entities, the Contest or any other entrant (each case as determined in Contest Entities’ sole discretion) are subject to disqualification from entry into the Contest. Contest Entities reserve the right to lock out persons whose eligibility is in question, who have been disqualified or are otherwise ineligible to enter the Contest. The failure of Contest Entities to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Contest Entities (excepting compliance with applicable codes and regulations), carrier delays/itinerary changes or other “force majeure” event will not be considered a breach of these Official Rules.
